These Terms of Service ("Terms") govern your use of Voixt AI, a product by Gothi Tech LLP ("we," "us," or "our"). By accessing or using our platform, you agree to these Terms and our Privacy Policy.

1. Description of Service

The Service provides access to a customizable, agent-based AI platform ("Agentic AI") for business users. It processes your user-provided content (“Content”) using Retrieval-Augmented Generation (RAG) and outputs AI-generated responses (“Output”).

The Service integrates with external AI APIs including:

These models are accessed via company-controlled API keys and are used strictly for inference, not training. The Service is hosted on Amazon Web Services (AWS) and other secure third-party platforms.

2. User Accounts

You must register an account to use the Service, either directly or via third-party authentication providers such as Google or Microsoft.
You must provide accurate and up-to-date information.
You are responsible for safeguarding your account credentials.
Notify us immediately at support@voixt.ai of unauthorized use.

3. Subscriptions, Payments, and Free Trial

Free Trial: We offer a 7-day free trial per subscription package. Payment information is required upfront.
Automatic Billing: After 7 days, your account is automatically converted to a paid plan unless canceled.
Subscription Plans: Monthly or annual billing. Details available on our Pricing Page.
Indian Rupee (INR - ₹) Localized Billing: For users in India, all transaction amounts, subscription plans, and top-up credits are displayed, calculated, and processed in Indian Rupees (INR) through certified localized gateways, subject to applicable Indian taxes (GST).
WhatsApp Business API & Usage Charges: Automated conversations, bulk broadcasting, and template-based messaging via WhatsApp are subject to WhatsApp and Meta’s official messaging fees and rules. You are responsible for configuring compliant templates and maintaining an active, approved Meta business registration.
Cancellations: Cancel any time via your account settings. Access remains until the billing cycle ends.
Refunds: Fees are non-refundable unless legally required or explicitly stated otherwise by us.

4. User Content and Ownership

a. Your Content

You retain full ownership of all data and content you upload or submit.

b. License to Operate

You grant us a limited, non-exclusive, royalty-free license to process and store your content only for delivering the AI services you explicitly request.

c. AI-Generated Output

You own the Output generated based on your content. However:
You are solely responsible for how the Output is used.
Output may be inaccurate, incomplete, or objectionable, and should be reviewed before use.

5. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable laws or regulations
Upload or generate unlawful, harmful, harassing, infringing, or misleading content
Violate WhatsApp Commerce Policies, Meta Developer Policies, or send unsolicited spam broadcasts
Utilize non-compliant or spoofed phone numbers, or bypass Indian regulatory guidelines concerning commercial telecommunications
Engage in fraud, abuse, or misleading practices
Spread malware, viruses, or malicious software
Reverse-engineer or tamper with the Service
Infringe upon any third-party intellectual property

We reserve the right to suspend or terminate your account without notice if you violate these rules.

6. Intellectual Property

The platform, UI, backend logic, and all branding associated with Voixt AI are the intellectual property of Gothi Tech LLP. You may not copy, use, or represent them without express written permission.

7. Third-Party Services and AI APIs

We use third-party APIs and services including:

We are not responsible for outages or failures of these services. By using our platform, you acknowledge these dependencies.

Additionally:

No user data is shared with these third-party AI services for training purposes.
Google user data, if connected via OAuth, is used only with user consent and never used to train AI models.
All integrations comply with Google's Limited Use Policy.

8. Google Drive & OAuth Integrations

We request only the minimum required scopes (drive.file, openid, profile, email).
Your data is accessed only for the files/folders you explicitly select.
We do not access, store, or view any other files in your Drive.
We do not train our AI systems on any content derived from your Google account.
You can revoke access anytime from your account or Google Security settings.

9. Termination

You may terminate your account at any time by canceling your subscription and discontinuing the Service.
We reserve the right to terminate or suspend access at our discretion, with or without notice, including due to violations of these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.
WE DO NOT GUARANTEE:
- UNINTERRUPTED OR ERROR-FREE OPERATION
- THAT AI OUTPUTS ARE FACTUAL, COMPLETE, OR NON-BIASED
- THAT INTEGRATIONS WITH THIRD-PARTY SERVICES WILL ALWAYS FUNCTION
You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOIXT AI (GOTHI TECH LLP) WILL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, REPUTATION, OR GOODWILL
OUR TOTAL LIABILITY IN ANY CASE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE LAST 6 MONTHS.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes will be handled exclusively in the courts of Ahmedabad, Gujarat, India.

13. Changes to Terms

We may modify these Terms from time to time.
We will notify you of material changes via:

- Updated "Last Updated" date
Continued use of the Service after updates means acceptance of the revised Terms.
